Senate Bill No. 1588, “An Act Establishing the Philippine National Public Parks System, and Appropriating Funds Therefore” or simply the “National Parks Act of 2022” was introduced in the Legislative by Senator Francis Tolentino on December 5, 2022. It is still currently pending in the Senate under the Committees on Tourism; Civil Service, Government Reorganization and Professional Regulation; Ways and Means; and Finance.
What is the Purpose of the National Parks Act of 2022?
This bill provides that it is the State’s policy to protect and maintain the health and well-being of the Filipino people through the establishment and preservation of parks and open spaces. The State recognizes parks and open spaces as valuable assets and it mandates:
- The establishment of the Philippine National Public Parks System for the conservation of the scenery, natural, and historical objects, and for the enjoyment in such manner and means that will leave them unimpaired for the enjoyment of future generations.
- The recognition that parks and open spaces contribute to human health and well-being, social identity, tourism, biodiversity, air quality, water management, and cooling the environment.
What are National and Local Public Parks?
This refers to public lands laid out as a public garden or used for public recreation. This does not refer to national shrines administered by the Philippine Veterans Affairs Office.
Who is the National and Local Public Parks Authority?
Chapter 2, Section 4 of the Bill provides the creation of the National and Local Public Parks Authority (NALPA). NALPA is primarily responsible for the National and Local Public Parks System by establishing policies, plans, and programs taking into consideration the following:
- establishment and maintenance of national and urban parks, open and green spaces, and recreational activities;
- coordination and cooperation of policies, plans, and programs of different concerned sectors of the Philippine society; and
- equal and active participation of the national government and appropriate agencies, LGUs, academe, and private sector to ensure that the National and Local Public Parks System shall be fully established and maintained.
Governing Board
The NALPA shall be governed by a Board composed of the following:
- Secretary of Tourism as the Chairperson
- Secretary of Environment and Natural Resources as Co-Chairperson
- Secretary of Public Works and Highways, Secretary of Agriculture, Secretary of Interior and Local Government, Chairperson of the Commission of Higher Education, and Director-General of the TESDA Secretariat as members.
In addition, the President of the Philippines shall appoint the following members from the private sector:
- Two representatives from a recognized professional architectural organization
- Two representatives from the academe, preferably in urban planning.
The NALPA board shall organize themselves that the term of office of 1/3 of their number shall expire every year. The member from the private sector who was appointed to fill the vacancies caused by the expiration of terms shall hold office for three (3) years.
The NALPA Board shall meet at least twice a year or as frequently as necessary by the Chairperson.
The President of the Philippines may revise the membership of the NALPA Board whenever the President deems it necessary for the effective performance of the Board’s functions through an administrative order.
Powers and Functions of the NALPA Board
The NALPA Board shall:
- Establish minimum quotas for all LGUs for the designation of municipal and city lands for public parks
- Manage the country’s National and Public Parks System, and shall assist other government agencies and LGUs in planning, establishing, and managing parks
- Promulgate, after due consultation with concerned groups and entities, policies, plans, programs, and guidelines for the effective implementation of this Act
- Establish and manage the National and Local Public Parks Institute
- Make Protected Areas accessible to the public for recreational purposes
- Organize and constitute standing committees for efficient integration and coordination of local open spaces and urban parks
- Exact reasonable fees and charges for services provided and training conducted and retain such earnings for its own use
- Create an Advisory committee to provide expert and technical advice
- Carry out other functions with a similar mandate and national scope.
The NALPA includes the NALPA Secretariat, NALPA Administrator and Chief Executive Officer, Deputy Administrators, and Regional Administrators.
The NALPA Secretariat is an independent agency of the executive department in charge of providing proactive leadership in the continuous development of systematic approaches and measures to maintain and manage the National and Local Public Parks System.
The Secretariat shall have the following Divisions:
- Finance Division
- Programs and Public Affairs Division
- Internal Audit Division
- Security and Safety Division
- Information and Communications Technology Division
- Cultural and Heritage Preservation Division
The NALPA Administrator and Chief Executive Officer shall exercise general supervision and control over its technical and administrative personnel. They also have the power to recommend to the NALPA the structural organization and personnel complement of the Secretariat. The Deputy Administrators shall assist the Administrator in Research and Development, National Public Park Operations and Management, Local Public Park Operations and Management, and Park Architecture and Planning.
Lastly, the Regional Administrators shall be under the direct control of the Administrator and shall oversee the operations of National and Local Public Parks at the regional level.
To ensure its independence and autonomy, the NALPA Secretariat shall be classified as a National Government Agency and be considered higher in level than a Bureau-level agency, and enjoy such privileges and special rules similar to a Government Owned or Controlled Corporation, and a State University or College.
National Parks Institute
This bill also provides that there is a National Parks Institute of the Philippines created, which shall be under the supervision of the Board.
In coordination with CHED, state universities and colleges, and other private universities and institutions, the Institute shall serve as a unique training and development arm of the Authority, aimed at supporting the purposes of this Act.
National Parks System
Within three (3) years from the effectivity of this Act, the NALPA shall make a comprehensive study of national parks, urban parks, open spaces, and recreational-area facilities programs of the national government and LGUS and other areas of land throughout the Philippines. The report will be submitted to the NALPA board and they have the power to declare the identified areas as either National Parks, Urban Parks, Open Spaces, or Recreational-Area Facilities.
However, Rizal Park and Paco Park are still considered National Parks and shall be under the jurisdiction of the NALPA.
The Administrator and its Provincial Administrators are strictly mandated to investigate, study, and monitor areas, whether it is located in a luxury real estate or not, whose overall circumstances exhibit qualities of national significance and that may have the potential to become a NALPA Park.
Acquisition of Land
The NALPA, through the Administrator, has the power to acquire land and interests in land within the boundary of any NALPA Park. Thus, if your luxury house and lot in Metro Manila or its nearby area has the potential of becoming a NALPA Park, the Administrator or any of its Deputies or Provincial Administrators shall exercise the power of eminent domain for the acquisition of land and establishment of an identified National Park.
Creation of Urban Parks and Open Spaces in LGUs
The LGUs of any area, such as Alabang, Santa Rosa, Laguna, or other places in the Philippines shall have an obligation to identify Urban Parks and Open Spaces within their jurisdiction.
Once an area is identified, it may become either NALPA Administered Park or maintain their nature as a Local Park at the LGU’s discretion.

Follow the Parking Policy in the Philippines
The first and most common parking policy in the Philippines is not parking on the side of the road with a “NO PARKING” signage on it. However, you can park on the streets without any No Parking signs as long as it is not a private road with its own car parking rules, and follow these exceptions:
- At or inside the intersection
- Do not block the driveway
- Double Parking
- Within a crosswalk
- Near the vicinity of overpass or footbridges
- Major national roads
- Do not park less than 4 meters from a fire hydrant and the entrance to a fire station
- Do not park less than 6 meters from the intersection of curb lines

They charge a fee for parking which is limited up to 3 hours only — but sometimes, that time is all you need. Street parking may not be suitable for all cities due to the size of the streets. The government discourages the public from parking anywhere, that’s why it’s highly recommended to park your vehicle in designated areas only. The consequences will depend on the time, place, and duration of the illegal parking. Illegally parked vehicles will also be subject to the LGU’s or the national government’s traffic rules and regulations. Fines for Illegal Parking Law in the Philippines

Due to the increasing need for parking spaces, 2nd District of South Cotabato Representative Peter Miguel filed House Bill No. 5292 entitled “An act requiring business establishments such as but not limited to shopping malls, supermarkets, schools, hospitals, hotels, and similar business, commercial and public establishments to provide free, adequate parking areas for their clientele and providing penalties for violations thereof” or simply the “Free Parking Bill.”
This House Bill seeks to mandate establishments to provide parking spaces for their customers. Rep. Miguel argued that the designated parking facilities are a “basic amenity” and a “matter of courtesy” to protect the interest of the patron or consumer, encourage more trade, and set a “good environment for business.”
The Congressman, in his explanatory note, said that this bill finds support in actual practices in other countries, such as the USA, where establishments provide free parking spaces to their customers.
Parking spaces in commercial establishments in Metro Manila charge P50 per hour, with additional charges per hour.
In the Free Parking Bill, Rep. Miguel defines “legitimate patrons” as any consumer who purchased products or availed services from the establishment. The bill also provides that the consumers can use the parking space of the establishment for at least two hours as long as they spend at least P500.
Rep. Miguel said that consumers who go to establishments that do not have the same parking facilities end up parking on the sidewalk or streets, “which will eventually result in traffic congestion.”
How will the Free Parking Bill Affect Business Owners, Malls, and other Commercial Establishments?
To offset the cost of free parking in these establishments, tax benefits will be provided to all mall owners and other similar establishments once the bill turns into law.
Will More Parking Help Congestion?
According to the Land Transportation Office and MMDA, private cars have taken up 80% of road space based on MMDA’s annual average daily traffic counts. But the data from the Japan International Cooperation Agency found that only 11% of Filipino households own a private car.
Experts and urban planners said that based on the economic phenomenon of induced demand, more roads and spaces can only lead to more frequent car use and eventually worsen road congestion instead of addressing it.
Commuter group AltMobility PH said that opening more roads can lead to induced demand, thus increasing traffic no matter how many roads or spaces will be opened. They added that “if we want to lessen traffic congestion, we have to lessen road dependency and improve public transport and active transport.”

Radio frequency identification (RFID) tags are widely used in transportation for toll, train, and bus cards. It has proven to be effective against out-of-line and colorum public vehicles. Also, it can be used in solving road crimes like car theft. Aside from transportation, RFID tags are embedded in identification documents such as company IDs, passports, school IDs, and membership IDs.
In 2006, the National Telecommunications Commission (NTC) issued a Memorandum Circular on the “Use and Operation of Radio Frequency Identification (RFID) within the 13.553-13.567 MHz, 918-920 MHz, and 2446-2454 MHz Bands.” This Memorandum regulates the approval, acceptance, registration, and licensing of RFID proximity readers.
To further enhance the protection of consumers with RFID tags, Senator Jinggoy Estrada filed on August 2022 the RFID Users Protection Act was filed by Senator Jinggoy Estrada this August 2022.
In his explanatory note, the use of radio frequency identification (RFID) tags and trackers has been proven to be useful, convenient, and economical. Many privacy laws in other countries cover the use of the data collected by RFID systems. Other states in the USA have enacted laws dealing with issues particular to RFID, such as unlawful scanning to defraud others or identity theft.
What is the RFID Users Protection Act?
The RFID Users Protection Act seeks to provide complete and appropriate information to consumers about the use of RFID tags and protect them from unauthorized access to their personal information stored in the said tags.
This act also mandates the seller or user of RFID tags to employ security measures to ensure the safety of the information being stored in the system.
What is RFID?
According to Section 2 (d) of the law, Radio Frequency Identification or RFID is a technology that uses radio waves to transmit data remotely to readers and is intended to carry data in suitable transponders, also known as tags.
RFID tag, on the other hand, is a microchip attached to an antenna that picks up signals from and sends signals to a reader. It contains a unique number but may include other information. RFID tags are classified into the following:
Active tag – used for long-distance purposes, such as toll highways, parking areas, and gas stations. Active RFID tags use small batteries that can send signals at a longer distance; and
Passive tag – used for near or close proximity to a reader and does not use any internal battery.
Notice Requirement
Under Section 3, any person who sells, issues, or distributes items containing an RFID tag must post a notice informing the consumer of the use of such technology. The notice must disclose the following information:
- The item contains or may contain an electronic communication device
- The consumer has the legal right to request that an item containing an RFID tag be removed or deactivated before the item leaves the store premises
- The consumer has also the right to request a copy of all personal information collected about himself or herself through an RFID tag, including the identity of any person who has had access to the consumer’s personal information.
Labelling Requirement
Under Section 4, any person who sells, uses, or distributes an item that contains an RFID tag must label the item with a notice stating that:
- The item contains an RFID tag capable of engaging in electronic communication; and
- The RFID tag can transmit personal information to an independent reader or scanner both before and after purchase or issuance.
Request to Review Personal Information
Section 5 of the RFID Users Protection Act provides that a consumer may request to review all stored personal information about himself or herself, including the identity of any individual or entity who has had access to the consumer’s personal information.
After reviewing one’s personal information, the consumer must be given the opportunity to contest the accuracy of their personal data, correct or amend the data, and request that the information be removed or destroyed from the database unless removing or destroying it is not allowed by law.
Removal or Deactivation
A person may request to remove or deactivate the device before he or she leaves the store premises. Once it is deactivated, it must not be reactivated without the express written consent of the person associated with the item.
Is a consumer with an RFID tag protected?
The law protects a consumer with an RFID tag. Any person who sells or utilizes an RFID tag must implement adequate security measures to ensure that the information is secure from unauthorized access, loss, or tampering. The security measures must be consistent with the industry standards commensurate with the amount and sensitivity of the information being stored on the system.
A person is not allowed to use an electronic communication device to scan an item associated with a consumer with the consumer’s knowledge. They must not also disclose or use, either directly or through an affiliate, the consumer’s personal information associated with the information gathered by, or contained within, an RFID tag.
Penalty for Unlawful Scanning
Anyone who intentionally scans another person’s identification device remotely, without that person’s prior knowledge or consent, for fraud, identity theft, or any other purpose shall be subject to a fine of not less than P50,000 but not more than P500,000.
What to Do with your RFID Sticker?
If you have a vehicle, you are already familiar with RFID stickers. But if you are a first-time driver and you have an RFID sticker for your car, what are you going to do with it? Some Considerations
When managing your RFID account, make sure that your RFID card is active, otherwise, if it has remained inactive or without load for at least six months, then your account will be automatically deactivated.
Another thing you have to consider is that your RFID load must be always about P100 or the minimum toll fee. If your load is less than the said amount, your card will be at risk for confiscation. On the bright side, reloading your card has become easier as there are several reloading sites. You can do any of these three options:
- Visit any installation site, which is located near toll gates.
- Reload through the EasyTrip website which offers various online channels, such as debit and credit cards, e-wallets, Gcash, etc.
- Reload at common bayad enters, like 7-11, LBC, SM Supermalls, ECPay, and more.

A sovereign wealth fund (SWF) is a state-owned investment fund consisting of money generated by the government from the country’s surplus reserves. SWF comes from various sources, such as state-owned natural resource revenues, trade surpluses, bank reserves, foreign currency operations, governmental transfer payments, and privatization money.
SWFs are created for targeted purposes. Some commodity-based SWFs in other countries manage the windfall from the disposition of natural for future generations’ benefit, as natural resources deplete and commodity prices become uncertain over time. Non-commodity-based SWFs, on the other hand, are designed to manage the accumulated foreign assets from trade surpluses and surpluses of state-owned enterprises to preserve the value of their capital and the return on investments.
As the Philippines continues to look for ways to hasten financial recovery, House bill No. 6398, also known as the Maharlika Investments Fund Act or the Maharlika Wealth Fund (MWF) was filed in Congress.
What is the Maharlika Wealth Fund?
The Maharlika Wealth Fund (MWF) seeks to establish a P275-billion state-owned sovereign wealth fund to maximize the profitability of investible government assets and support the current administration’s economic agenda.
The Maharlika Fund is patterned after the SWFs of other countries, such as China, Hong Kong, Singapore, South Korea, Malaysia, Indonesia, Taiwan, East Timor, and Vietnam.
This fund would draw resources from contributions from state pension funds, such as the Government Service Insurance System (GSIS), Social Security System (SSS), Landbank of the Philippines (Landbank), and Development Bank of the Philippines (DBP). Other annual contributions may also come from the Bangko Sentral ng Pilipinas (BSP), Philippine Amusement Gaming Corp. (PAGCOR), and the national budget.
Under the proposal, here is the breakdown of the contributions from various government financial institutions:
P125 billion – GSIS
P50 billion – SSS
P50 billion – Landbank
P25 billion – DBP
P25 billion – national government
How will the MWF be used?
The MWF funds will be used as investments for various outlets, such as foreign currencies, fixed-income instruments, metals, equities, domestic and foreign corporate bonds, mutual and exchange-traded funds, commercial estate, including luxury real estate and luxury condominiums, and infrastructure projects.
The MWF will adhere to the Santiago Principles, which are the 24 generally accepted principles and practices agreed to in October 2008 in Santiago, Chile.
The stakeholders of the fund are committed that the sovereign wealth fund will comply with the applicable regulatory and disclosure requirements in countries in which SWFs invest and that the SWFs will have a transparent government structure providing operational controls, risk management, and accountability.
Former President and Rep. Gloria Macapagal Arroyo noted that this SWF is a “valuable source.” According to her, the President can count on advice from the Department of Finance, and “historically,” our country has a good track record insofar as the finance secretaries are concerned.
Arroyo added that the operations of the MWF can “transparently be observed, tracked, and monitored” here and abroad.
Maharlika Investment Corp. will be administered by a nine-man board of directors, all of whom will be representing the contributing government financial institutions. The board will also include two independent directors.
Maharlika was a term used by the late former President Ferdinand Marcos Sr. as his propaganda tool to refer to his guerilla unit during World War II.
In the bill’s explanatory note, the Maharlika Fund could be used to manage foreign reserves and attract direct investments. It cited the success of the Indonesia Investment Authority and Singapore’s GIC.
The bill was filed by majority leader Manuel Jose Dalipe, senior deputy majority leader Ferdinand Alexander Marcos, Tingog Representatives Yedda Marie Romualdez and Jude Acidre, House Speaker Martin Romualdez, and House appropriations panel senior vice chair Rep. Stella Quimbo.
Why is MWF controversial?
One of the reasons why MWF raises concern among critics is the current economic conditions of the Philippines, like the budget deficit, mounting debts, and high inflation rate.
Action for Economic Reforms Coordinator Filomeno Sta. Ana III explains that the SWF only works when the country has a huge surplus. For instance, in Norway, Sta. Ana says that the surplus from its extractive industries has been accumulated over the long term. Norway has the largest SWF in the world, providing $250,000 for each Norwegian citizen because of its oil and gas profits.
Senator Imee Marcos, the sister of the President of the Philippines, also questioned the idea of the bill due to the economic turmoil. She told the media that investing in the MWF is quite a high risk as the global economy is so bad. She also added that foreign models like that of Norway may not be applicable to the Philippines.
Another reason why the Maharlika Wealth Fund is controversial is the story of the 1Malaysia Development Berhad (1MDB) corruption scandal. Former Malaysian Prime Minister Najib Razak was found guilty of pocketing billions from Malaysia’s SWF in 2020.
Senator Jinggoy Estrada also expresses his concern over the Maharlika Fund. While he is not against the bill, they still have to see the need for it.
According to Enrico Patiga Villanueva, senior lecturer of economics at the University of the Philippines Los Baños, it is better to work toward unifying the GSIS and SSS instead because there are already fund managers in the two institutions.
A Change.org petition titled “Hands off our SSS and GSIS contributions, NO TO House Bill 6398!” was launched by netizens to pressure Congress to prevent the passage of this bill.

On December 9, 2022, the House Committee on Appropriations officially dropped the Government Service insurance system (GSIS) and Social security system (SSS) from the sources of funds for the proposed MWF. This leaves the Bangko Sentral ng Pilipinas (BSP) as the main contributor to the Maharlika Fund.
Under the revised Section 9 of the bill, Landbank and DBP will continue to be tapped for the contributions, but the National Treasury of the national government will no longer be sourced for funds.
The removal of GSIS and SSS was because of the public pressure to remove these two state pension funds as sources for the MWF.
This leads to the proposal of a 50-50 sharing scheme between the BSP and the national government for the initial year of the MWF, which is envisioned to raise more funds for large government projects.
However, the MWF bill is sent back to its mother committee, the Committee on Banks and Financial Intermediaries, for the approval of the changes. The bill was also expected to be approved on the second reading by the House of Representatives before the holiday break.
