The Makati Business Club (MBC), a prominent business group in the Philippines, is advocating for the immediate passage of a law that would simplify tax payment procedures for Filipinos. In a recent statement, the MBC expressed its hope that the government would enact an Ease of Paying Taxes Act (EOPT), which aims to enhance the taxpayer’s capacity for compliance, bolster the government’s finances and internal revenue, and facilitate the creation of more jobs.

The MBC extended its gratitude to the Senate Ways and Means Committee for approving the Ease of Paying Taxes bill (SB 2224). The group respectfully urged the Senate to pass the measure, emphasizing the importance of both houses reaching an agreement and enacting the law. The MBC highlighted the significance of an EOPT bill in making tax payments more accessible for all citizens, particularly micro and small enterprises. Simplifying the process would enable individuals and businesses to fulfill their duty of funding government infrastructure, programs, services, and national security.

Moreover, an EOPT law would enable businesses, especially micro, small, and medium-sized enterprises (MSMEs), to allocate more time and effort to job creation. Recognizing the leadership demonstrated by Representative Joey Salceda on EOPT, the MBC commended the House of Representatives for passing its counterpart, HB 8942, in September 2022. The group eagerly anticipated proposed changes to the National Internal Revenue Code (NIRC) or the Tax Code, including improved taxpayer classification into micro, small, medium, and large categories, each with a tax base and a specialized unit to cater to their specific needs. Additionally, they emphasized the need for simplified tax returns and processes for micro and small taxpayers.

Simplified Rules

The EOPT bill goes beyond simplifying tax payment procedures; the taxpayer’s bill also aims to implement simplified tax rules and regulations for easier compliance. One of the key changes proposed in the bill is the elimination of the distinction between the documentation and basis of sales and services subject to Value Added Tax (VAT). Currently, sales subject to VAT require invoices, while official receipts cover services subject to VAT. The bill proposes to streamline the basis of gross sales and documentation by only requiring VAT invoices for both sales and services, providing a more uniform approach.

Furthermore, the bill seeks to make administrative reforms by adjusting the P3-million VAT threshold, which was previously increased by the Train Law, to its present value not later than January 31, 2021, and every three years thereafter. This adjustment would be based on the consumer price index published by the Philippine Statistics Authority, ensuring that the threshold keeps up with inflation and that tax reform maintains its effectiveness.

In addition to simplifying VAT administration, the EOPT bill proposes a significant change to tax laws regarding the payment of taxes. It suggests allowing taxpayers to make tax payments before they are due, offering more flexibility in managing tax obligations. This means that taxpayers would no longer be required to pay taxes simultaneously with the filing of their returns, providing them with the option to settle their tax liabilities ahead of time.

The MBC expressed its anticipation for changes such as allowing taxpayers to file and pay their taxes in any revenue district office, not solely limited to their designated revenue district offices (RDOs). They also advocated for taxpayers to have the option to file and pay their taxes physically or electronically, as well as the ability to file and pay income tax in just the principal office of one RDO instead of multiple RDOs they operate in. The bill likewise seeks for the removal of the annual registration fee.

With a respectful tone, the MBC encouraged the Senate to pass a version of the bill after interpellation and necessary amendments. The organization acknowledged that constructive dialogue and revisions to the House bill are essential to ensure an effective EOPT law.

Bill of Rights

The EOPT bill seeks to establish reasonable criteria for taxpayer classifications, which include the taxpayer’s tax compliance with the amount and type of tax paid, etc.

Salceda has called on the Philippine Institute of Certified Public Accountants (Picpa) to collaborate in developing a comprehensive Taxpayer Bill of Rights. In support of this collaboration, Salceda intends to invite Picpa representatives to participate in congressional hearings to discuss concerns related to the 90-day Value Added Tax (VAT) refund system and the imposition of VAT on indirect exporters. He has assured that there is already a House resolution in place to invite Picpa representatives, and the House of Representatives is committed to taking action on this resolution.

The Department of Tourism (DOT) has recently raised concerns about the number of visitors flocking to Boracay, urging the local government to stick to the recommended daily limit of 19,215 while a review of the island’s carrying capacity is underway. This issue came to the forefront during Holy Week when the number of tourists exceeded the set threshold.

The Department of Environment and Natural Resources (DENR) is currently reviewing a carrying capacity study conducted in 2018. It’s an important step towards managing tourism effectively on the island, ensuring that it remains a paradise for years to come.

Concerns about Exceeding the Daily Limit

During Holy Week, the number of tourists staying on Boracay surpassed the daily full capacity limit set by the DOT. On April 14, there were 21,252 tourists recorded, and the following day saw an increase to 22,519. However, it’s important to note that these figures differ from the data provided by the Malay Tourism Office, which only considered new arrivals and not guests already present on the island. This distinction is crucial in understanding the actual number of tourists within the carrying limits.

Malay LGU Called Out for Breach

The DOT called the attention of the Malay Local Government Unit for breaching the Boracay carrying capacity of the island.

According to data from the Municipal Tourism Office of Malay, 62,241 people went on a holiday to Boracay during the Lenten break this year, from April 2 to 9. This was a huge increase of 38 percent compared to last year’s Lenten break, when only 44,981 tourists visited the island from April 11 to 17, 2022.

Out of the total number of tourists, 80 percent (50,015) were locals, while there were 11,535 foreigners, and 691 overseas Filipino workers who enjoyed their vacation in Boracay.

Boracay exceeded its limit on three specific days. On April 6 (Maundy Thursday), there were 25,480 tourists present. On April 7 (Good Friday), the number rose to 25,294, and on April 8 (Black Saturday), there were 23,284 tourists on the island, despite some departures to other establishments occurring each day. However, it’s worth noting that a study conducted by the DENR determined that the maximum capacity for tourists on the island should be 19,215 at any given time.

Boracay consistently ranks among the most sought-after islands in the world, as reported by various international travel publications and news sites, mainly because of its picturesque white sandy beach.

Tug of War

Crisanta Marlene P. Rodriguez, the Director for Region 6 (Western Visayas) at the DOT, has urged the mayor’s office to pay attention to Boracay’s existing carrying capacity after observing the breaches. Carrying capacity refers to the ability of an ecosystem to support people and other living beings without adverse effects.

Despite multiple attempts by the newspaper to contact him, Malay Mayor Frolibar Bautista did not provide any comment on the matter.

On the other hand, Roberto “Bob” Zozobrado, the President of the Tourism Congress of the Philippines, described the issue in Boracay as a “tug of war” between profitability and sustainability. He believed that the DENR study was an attempt to establish some level of control. However, he questioned the monitoring process and said, “I would advocate for an increase in Boracay’s carrying capacity to ensure the sustainability of the destination’s products and services.”

He also noted that these breaches occur only on a few weekends throughout the year. The past issues were the result of neglect over decades, not just by the stakeholders but also by the local government. Now, everyone is aware of the steps they need to take to ensure its sustainability.

During an interview, an anonymous resort manager on the island expressed that exceeding the carrying limit was seen as positive news by stakeholders, as it led to increased business. They highlighted the existence of the Boracay-Caticlan Sustainable Development Council, which acts as a similar body to the Boracay Island Inter-Agency Task Force (BIATF), and stated that discussions were held regarding the proposal for a higher limit of the island.

Considering recent infrastructure improvements made by the government, the island’s stakeholders have requested an increase in the carrying limit. This appeal comes after the breach of the carrying limit during the previous year’s Holy Week.

The DOT is awaiting a response from the LGU of Malay regarding the violation of the daily limit. While the letter from Tourism Secretary Bernadette Romulo-Puyat was initially addressed to the DENR, it was also copied to the DILG. Collaborative efforts are underway between the DENR, DOT, and the Department of the Interior and Local Government (DILG) to find suitable measures and resolve the issue. The Boracay Inter-Agency Rehabilitation Management Group, consisting of representatives from these agencies, will lead the coordination and decision-making process.

Former Senator and now House Deputy Speaker Ralph G. Recto appealed to his colleagues in the House of Representatives to pass Estate Tax Amnesty Extension Bill, according to the BusinessMirror report.

According to Recto, he believes that “former classmates can pass what is a simple bill” without waiting for President Ferdinand Marcos Jr. to certify the bill as urgent.

Under the tax amnesty act, the period to file the benefits shall expire on June 14, which means the clock is ticking as per Recto.

Even if revenue bills should originally start from the House, the Senate can also already start tackling these bills, so that when the House Bill arrives in the Senate, the Senate can focus more on floor debates.

The bill moving the deadline for estate tax amnesty to June 14, 2025, has been hurdled by the House Ways and Means Committee, which paves the way for plenary debates. Through this, the passage of the amnesty would be certain.

What is House Bill No. 7409, or the Estate Tax Amnesty Extension Bill?

House Bill No. 7409 proposes to extend the period to avail of the tax amnesty to June 14, 2025, from the current deadline of June 14, 2023. The bill was co-authored by House Speaker Martin Romualdez, Majority Floor Leader Zamboanga City Representative Manuel Jose Dalipe, Ilocos Norte Representative Ferdinand Alexander Marcos, and Tingog Party-list representatives Yedda Marie Romualdez and Jude Acidre.

If this bill is passed into law, this would be the second extension of the estate tax amnesty under Republic Act (RA) No. 11213, which ran from 2019 to June 14, 2021. This was followed by Republic Act 11569 which extended the estate tax amnesty period for two years from June 15, 2021 to June 14, 2023.

The current law provides taxpayers a one-time opportunity to settle any unpaid tax obligations on the estates of decedents who died on or before December 31, 2017.

Under the Tax Code, a 6% rate is imposed on the decedent’s estate taxes at the time of death without penalties. The Ways and Means Committee also approved the provision exempting heirs from paying 6% donor’s tax on any donated estates amounting to Php 1 million and below.

According to the Ways and Means Committee Chairman and Albay Rep. Jose Salceda, this tax amnesty is yet to be optimized. He said during the committee hearing that “families still struggle to comply with documentary as well as cash requirements. Hence, our leadership filed this measure to give more time to our constituents to clear their obligations.”

The Bureau of Internal Revenue (BIR) already set a Php 6-billion target collection from the tax amnesty. Assistant BIR Commissioner Maria Luisa Belen said that 133,860 taxpayers availed of estate tax amnesty starting 2019 up to the present, generating Php 7.4 billion for the government.

The BIR reported that 61,566 have availed of the first estate tax amnesty from 2019 to June 14, 2021, generating Php 4.89 billion. And ever since June 15, 2021, the second extension garnered Php 2.4 billion from 72,294 taxpayers.

Effect of COVID-19 on Settling Estate

Rep. Salceda said that the COVID-19 pandemic hampered the attempts to settle their deceased’s estate. Salceda also said that this will be the last time to extend the estate tax amnesty, as it defeats the purpose of tax compliance if tax violations will always be forgiven.

Even Erwin Vincent Alcala, the national executive vice-president of the Philippine Institute of Certified Public Accountants, agreed to Salceda’s statement that this should be the final extension because the amnesty may be prone to abuse.

Recto was among the authors of Republic Act (RA) No. 11213 while he was in Senate. This law erased penalties and cut the rates for estate tax obligations significantly. However, the period for availing of the amnesty coincided with the COVID-19 pandemic. This prompted Congress to pass RA No. 11569, and should this period be extended for two more years, “families will save billions while the government will earn billions.”

It was said that the extension is a “lifeline to a government scrounging for revenues and an act of kindness” to senior citizens who were prevented from availing of the amnesty during the pandemic.

The Bureau of Internal Revenue (BIR) stated during the hearing of the House Committee on Ways and Means that President Marcos Jr. avail himself of the tax amnesty program of the BIR because of his family’s alleged P 203 billion unpaid estate taxes.

BIR Assistant Commissioner Ma. Luisa Belen referred to Section 9 (a) of the Tax Amnesty Act, which provides that the tax amnesty “shall not extend to estate tax cases which shall have become final and executory and to properties involved in cases pending in appropriate courts … falling under the jurisdiction of the Presidential Commission on Good Government (PCGG).”

House Deputy Minority leader France Castro of ACT Teacher Partylist said that Marcos should set an example by paying their tax delinquencies. She also added that the Marcos administration had no moral authority to compel delinquent taxpayers when he himself and his family have taxes owed to the Filipino people.

Addressing concerns about the cumbersome process of availing estate tax amnesty, Juanito H. Balbastre III, the officer-in-charge of the BIR law and legislative division, expressed a willingness to accept applications for amnesty even in the absence of proof of settlement. He highlighted that the law explicitly allows for the removal of this requirement, citing the BIR’s Revenue Regulations 17-2021 during his remarks to the committee.

On Donor’s Tax

The committee also granted approval to a motion within the bill that would provide an exemption to heirs from paying donor’s tax if the value of the property donated by their parents is P1 million or less.

Salceda, the chairman of the House Ways and Means Committee, expressed his belief in allowing individuals who are still alive, as they are familiar with their own children, to have the authority to make decisions. He initiated the provision and supported the motion put forth by Nueva Ecija Rep. Ria Vergara. If this provision is passed by the Senate and signed into law by President Marcos, heirs will be exempt from paying the standard fixed rate of six percent if the estate’s value is one million pesos or below.

Salceda suggested this exemption as an alternative to passing these laws. The intention is to enable parents to transfer assets to their children before their time, thereby relieving the heirs of the burden of paying the donor’s tax.
